Website Terms of Service

Effective date: 2026-06-04

1. Introduction

These Terms of Service (“Terms”) govern your use of the website, accessible at ce-red.org and any associated subdomains (the “Website”).

By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please leave the Website immediately.

2. About the Website

2.1 Purpose

The Website provides information about CERED, a software platform designed to assist manufacturers in managing CE marking compliance for products sold in the European Union. The Website describes our services, platform features, pricing, and related information.

2.2 Informational Nature

All content published on the Website is provided for general informational purposes only. Nothing on the Website constitutes legal advice, regulatory advice, engineering guidance, or any other form of professional advice.

2.3 No Professional Advice

The information on this Website does not constitute legal, technical, regulatory, or compliance advice. EU product compliance is a complex, jurisdiction-specific area of law and engineering. You should always consult qualified legal counsel and technical experts before making any compliance decisions.

2.4 No Certification or Conformity Decision

The Website does not make, imply, or guarantee that any product complies with EU regulations, directives, or harmonised standards. References to CE marking, declarations of conformity, essential requirements, or harmonised standards are descriptive only and do not constitute a conformity assessment, a notified body opinion, or any legally binding determination of compliance.

2.5 No Professional Relationship

Browsing the Website or submitting an enquiry does not create a client relationship, a consultancy engagement, or any other professional relationship between you and CERED.

2.6 Product and Feature Information

Descriptions of platform features, capabilities, and roadmap items are subject to change without notice. We do not warrant that the platform will always operate as described on the Website.

2.7 Third-Party References

References to EU regulations, directives (such as RED 2014/53/EU, LVD 2014/35/EU, EMC 2014/30/EU, CRA), harmonised standards, the Official Journal of the European Union (OJEU), notified bodies, or test organisations are included for descriptive purposes only. We are not affiliated with, endorsed by, or acting on behalf of any regulatory body, standardisation organisation, or the European Union.

2.8 Visitor Responsibility

You are solely responsible for verifying the accuracy, completeness, and suitability of any information obtained from this Website before relying on it for any purpose.

3. Use of the Website

4. Website Content and Intellectual Property

The Website and all of its content — including but not limited to text, graphics, logos, icons, images, data compilations, and software — are the property of CERED or its content suppliers and are protected by applicable intellectual property laws.

4.2 Permitted Public Use

You may view and print reasonable extracts of pages from the Website for your own personal, non-commercial reference, provided you do not modify them and you retain all copyright and proprietary notices.

5. Downloadable Materials

5.1 As-Is Materials

Any whitepapers, guides, sample documents, or other downloadable materials provided on the Website are offered on an “as is” basis without any warranty of accuracy, completeness, or fitness for a particular purpose.

5.2 No Reliance

Downloadable materials should not be relied upon as legal or technical advice. In particular, sample declarations of conformity, technical file templates, or standard checklists are illustrative examples only and must be reviewed by qualified professionals before use.

5.3 Redistribution Restrictions

Unless otherwise stated, downloadable materials are for your internal, non-commercial use only. You may not redistribute, sell, or publish them without our prior written consent.

6. Contact Forms and Submitted Information

6.1 No Confidential Submissions

Any information you submit via the Website’s contact forms, demo request forms, or any other submission mechanism is not treated as confidential unless we have entered into a separate written confidentiality agreement with you.

6.2 Right to Submit

By submitting information through the Website, you confirm that you have the right to do so and that the submission does not infringe any third party’s rights.

6.3 Use of Submissions

We may use information you submit to respond to your enquiry, improve our services, and as otherwise described in our Privacy Policy.

6.4 Feedback

If you submit feedback, suggestions, or ideas about the platform or Website, you grant us a perpetual, royalty-free licence to use, modify, and incorporate that feedback into our products and services without obligation or compensation to you.

7. Privacy and Cookies

Your use of the Website is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Website you consent to the data practices described in those policies.

Inclusion of a link does not imply endorsement by CERED.

9. Availability and Changes

We do not guarantee that the Website will always be available, uninterrupted, or error-free. We may suspend, withdraw, or restrict access to all or any part of the Website for business or operational reasons at any time without notice.

We reserve the right to update, modify, or remove any content on the Website at any time at our sole discretion.

10. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW:

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable Estonian or EU law.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CERED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability to you for any claim arising out of or relating to your use of the Website shall not exceed EUR 100.

12. No Binding Offer; Separate Agreement Controls

12.1 Website Content is Not an Offer

Any pricing, feature descriptions, plans, or commercial terms displayed on the Website are for indicative purposes only and do not constitute a binding offer, quotation, or contract. No contract for the supply of services is formed merely by your browsing the Website or submitting an enquiry.

12.2 Subscription Agreement Governs Platform Use

Access to and use of the CERED platform (as opposed to this Website) is governed exclusively by the separate Subscription Agreement or Master Services Agreement concluded between you (or your organisation) and CERED at the time of sign-up. In the event of any conflict between these Website Terms and that agreement, the Subscription Agreement prevails with respect to platform use.

12.3 Features Subject to Change

We reserve the right to add, modify, or discontinue platform features at any time. Nothing on this Website creates an entitlement to any specific feature, integration, or service level.

13. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless CERED and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

We reserve the right to assume exclusive control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence of that claim.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. EU mandatory consumer protection rules remain unaffected.

Any dispute arising out of or in connection with these Terms or your use of the Website that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.

If you are a consumer resident in the European Union, mandatory consumer protection rights and available consumer dispute resolution mechanisms in your country of residence remain unaffected.

We may revise these Terms at any time by updating this page. The “Effective date” at the top of this page will reflect the date of the most recent revision.
